Intellectual Property Policy
Last updated:
Embroidery is a small art: a few hundred stitches can carry a design someone spent hours drawing, or a name that matters to a family. This Intellectual Property Policy explains what belongs to Embro Haven on embrohaven.shop, how you may and may not use it, why we never stitch other people’s brands, teams or characters, and how to tell us if you think something on our site or in an order uses your rights without permission.
Intellectual property in short
- Our content: designs, photos, text, the Embro Haven name and the hoop logo belong to us or are used with permission.
- Personal use: share links to our pages and wear what you buy; please do not copy or resell our designs.
- Personalisation: we stitch names, initials, dates and your own short words — never team names, brand names, logos or characters.
- Reporting a concern: email support@embrohaven.shop with the subject “IP concern”; we reply within 24 hours on business days.
- Copyright notices: follow the steps on our DMCA page.
1. What belongs to Embro Haven
Unless stated otherwise, the following are owned by Embro Haven or used under licence:
- Embroidery designs shown in the shop — for example the wildflower sprig, the single-line mountain range, the tiny wave, the pine tree, the little mushrooms, the daisy chain, the moon and stars, the botanical sleeve vine, the honeybee, the sun over mountains, the paper plane, the rainbow, the lemon slice, the cherry pair, the line-art cat, the floppy-eared dog, the constellation sleeve and our script phrases;
- photographs and images of our products and banners;
- written content, including product descriptions, guides, FAQs and policy pages;
- our name and brand: “Embro Haven”, the hoop-and-“EH” mark, the wordmark with its running-stitch underline and the site’s look and feel.
Buying a piece gives you ownership of that physical piece. It does not transfer the rights in the design, which stay with us.
2. What you are welcome to do
- Wear, gift and resell the physical pieces you bought from us, as you would any garment.
- Share links to our product pages and post your own photos of pieces you own, on social media or anywhere else.
- Quote short passages from our pages for reviews, comment or news, with a link back.
- Print or save pages for your personal reference, such as the Size Guide or a policy page.
3. What we ask you not to do
- Copy, trace or redraw our embroidery designs to produce and sell items of your own.
- Use our product photos or written descriptions on another shop, marketplace listing or advertisement.
- Use the Embro Haven name or logo in a way that suggests we endorse or partner with you.
- Register domain names, social accounts or business names that could be confused with Embro Haven.
- Scrape or bulk download content from the site for commercial use.
If you would like to use something in a way not covered here — for a feature, a collaboration or a school project — just ask. We say yes more often than you might think, and a short email describing the use is all it takes to start.
4. Our name and marks
“Embro Haven” and our hoop-and-“EH” mark identify our shop and our products. Please use them only to refer to us accurately, for example “I bought this cap from Embro Haven”. Do not change the logo, combine it with other marks or use it on products. We have not claimed registration of these marks on this page, and we do not use registration symbols that we are not entitled to use.
5. Why we never stitch other people’s brands
A lot of embroidery requests are for something recognisable: a favourite team, a brand logo, a cartoon character, a band name, a university crest. We understand why — but these names and images belong to their owners, and stitching them without a licence would infringe their rights. So we have one firm rule: we do not stitch team names, brand names, logos, characters or other people’s protected works, whether they are in our designs or typed into a personalisation field.
In practice this means:
- our own designs are original motifs, simple shapes and our own phrases;
- personalisation fields are for names, initials, dates and your own short words;
- we do not suggest or prefill team names, brand names or characters anywhere on the site;
- if an order’s text appears to use someone else’s trademark or character, we email the customer, suggest an alternative and, if we cannot agree, cancel and refund the order in full.
Grey areas we are careful about
Some words are both ordinary and trademarks, and some names belong to real people as well as famous ones. We judge each case sensibly: a first name like “Riley” on a beanie cuff is a name; the same word together with a team’s colours and number is not something we will make. A city name like “Pittsburgh” on a sleeve is fine; a team’s official logo or slogan for that city is not. If we are unsure, we ask you first rather than cancel without explanation.
Examples of text we can and cannot stitch
| Typed text | Can we stitch it? | Why |
|---|---|---|
| AMR (three initials) | Yes | Your own initials |
| J+M on a hoodie chest | Yes | A couple’s initials |
| EST 2019 on a sleeve | Yes | A date that matters to you |
| A child’s or pet’s first name on a beanie cuff | Yes | A personal name |
| A city or neighbourhood name | Usually yes | A place name on its own is not someone’s brand |
| A sports team’s name or nickname | No | Team names are protected marks |
| A clothing, drink or tech brand name | No | Brand names belong to their owners |
| A cartoon, film or game character’s name | No | Characters are protected works |
| Song lyrics or a famous slogan | No | Usually protected by copyright or trademark |
The table is a guide, not a complete list. When a request falls between the lines, we email you before we start stitching, so your order is never cancelled without a conversation.
6. Lettering and type
The lettering styles we stitch — block capitals and script — are digitised for embroidery for use in our shop. Fonts and digitised lettering have their own licences. We do not copy another brand’s custom lettering, and we do not take requests to “match the font” of a logo, team jersey or product packaging, even when the words themselves would be fine to stitch.
7. Product images while photography is prepared
Some product pages may show a placeholder or an illustration while our product photography is being prepared. Every image we publish is meant to be our own or properly licensed. If you believe an image on our site is yours and was used without permission, the reporting steps below apply and we treat the report as urgent.
8. Your text and your ideas
The personalised text you type stays yours. We use it only to stitch your order and to handle questions or returns about it, as our Privacy Policy describes. We do not publish customers’ personalised text or reuse it in our designs.
If you send us an idea for a new design, please know that we may already be working on something similar, and that we cannot promise payment or credit for unsolicited ideas. We will never present your personal photos or messages as our own, and we will always ask before showing a customer’s photo anywhere.
9. How to report an intellectual property concern
If you believe something on embrohaven.shop — or a piece we made — uses your trademark, design right, copyright or other intellectual property without permission, please email support@embrohaven.shop with the subject “IP concern” and include:
- your name, the name of the rights owner if different, and how to contact you;
- what right you hold — for example a registered trademark (with its number and country), a design or a copyright;
- the exact page address on our site, or the order details if you have them, and a description of the material concerned;
- why you believe the use is unauthorised;
- a statement that the information is accurate and that you are the owner or authorised to act for the owner.
For copyright specifically, the formal notice requirements on our DMCA page apply.
10. What happens next
- We confirm receipt within 24 hours on business days.
- We review the concern and the material. Where the concern appears valid, we remove the product or content, or change it, and tell you what we did.
- If we disagree, we explain our reasons and invite you to send more information.
- Where the concern involves a customer’s personalised order, we may contact that customer as part of resolving it, sharing only what is needed.
We aim to resolve concerns quickly and in good faith. Contacting us does not affect any legal rights you have.
11. Reselling pieces you own
Once you have bought a piece, you may sell it second-hand, give it away or swap it, just as you would any other garment. When you list it, you may say that it came from Embro Haven and use your own photos of it. Please do not copy our product photos or descriptions into the listing, and do not describe the piece as new stock from us or suggest that you are an authorised seller, because we do not have resellers.
12. Requests to make a design for a group
Clubs, families and friend groups sometimes ask whether we can turn their own artwork into embroidery. At the moment our shop offers its own designs plus text fields, and we do not take custom artwork orders. If you own a design and would like to discuss it in the future, write to us; we will be clear about what we can and cannot do, and we will never use your artwork without your written permission.
13. If you see our designs used elsewhere
We are grateful when customers tell us they have spotted our designs or photos on another shop. Send us the link and, if possible, a screenshot. We may not reply with every step we take, but we read every report, and a clear link plus the date you saw the copy makes it much easier for us to follow up with the other site or marketplace.
14. Questions and permission requests
For permission to use our content, questions about this policy or anything else related to intellectual property, email support@embrohaven.shop or write to Embro Haven, 2205 Groveland St, Pittsburgh, PA 15234, US. Related pages: Terms of Service, DMCA and Contact Us.
