Embro Haven respects copyright, and we expect the same of the people who order from us. This page explains how to tell us if you believe something on embrohaven.shop — a design, a product photo, a piece of text — copies your copyrighted work without permission, what information we need, what we do when we receive a notice, and how someone can respond if they believe a notice was a mistake. It follows the notice-and-takedown approach of the US Digital Millennium Copyright Act (DMCA).
Embro Haven is a single-brand shop: we design and sell our own embroidered pieces, and there are no third-party sellers on the site. Copyright questions therefore usually concern our own designs and images, or personalised text a customer asked us to stitch.
Copyright notices in short
- Where to send a notice: support@embrohaven.shop, subject line “Copyright notice”, or by post to Embro Haven, 2205 Groveland St, Pittsburgh, PA 15234, US.
- What to include: the six items listed in section 3.
- Our first reply: within 24 hours on business days, confirming we received it.
- What we do: review the notice and, where it is complete and valid, remove or disable the material.
- Counter-notices: possible where material someone submitted was removed by mistake.
1. What this page covers
This page is about copyright: rights in original creative works such as illustrations, embroidery designs, photographs and written text. It covers anything published on embrohaven.shop, including:
- embroidery designs shown on product pages — motifs like a wildflower sprig, a single-line mountain range or a constellation;
- product photographs, banners and other images;
- written content such as product descriptions, guides and policy pages;
- the logo and visual elements of the site.
If your concern is about a trademark — a brand name, team name, logo or character — please see our Intellectual Property Policy, which covers trademarks and other rights and uses a similar reporting process.
2. Before you send a notice
Copyright protects a particular expression of an idea, not the idea itself. Many simple motifs — a daisy, a pine tree, a crescent moon, a coffee cup — are drawn by countless designers in their own ways, and a similar subject is not by itself a copy. Before sending a notice, please compare the specific lines, shapes and arrangement of your work with ours. If you are not sure, you are welcome to write to us informally first; we would much rather talk than have a misunderstanding.
Also consider whether the use might be permitted, for example because you licensed the work to us or because the use is a fair use under US law. Sending a notice that knowingly misrepresents infringement can have legal consequences (see section 9).
3. How to send a copyright notice
Send your notice in writing to support@embrohaven.shop with “Copyright notice” in the subject line, or by post to the address above. For us to act, the notice must include:
- Your signature — physical or electronic (typing your full legal name is acceptable) — as the copyright owner or a person authorised to act for the owner.
- Identification of the copyrighted work you believe is infringed, such as a link to where your work is published, a copy of the image, or a registration number if you have one.
- Identification of the material on our site that you believe infringes, with enough detail for us to find it — ideally the exact page address (for example a product page under /products/) and a description of which image or design you mean.
- Your contact information: name, postal address, email address and, if you wish, a telephone number.
- A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on the owner’s behalf.
Notices missing one or more of these items may delay our response. If something is missing, we will tell you what we need.
A tip for clear notices
Side-by-side screenshots help enormously. If you can show your original design next to the image on our page, with the date your work was first published, we can usually assess the notice much faster.
4. What we do when we receive a notice
- We confirm receipt within 24 hours on business days.
- We review the notice for completeness and look at the material it identifies.
- If the notice is complete and the claim appears valid, we remove the material or disable access to it — for example by taking a product offline or replacing an image.
- If the material was supplied by someone else (for instance personalised text or an image a customer sent us), we notify that person where we can and tell them about the counter-notice process.
- We reply to you with what we did.
If we decide not to act — for example because the notice is incomplete or the design is clearly our own original work — we explain why, so that you can respond or provide more information.
5. Three examples
A design that looks like yours
An illustrator notices that one of our crewneck motifs uses the same unusual arrangement of leaves, the same line breaks and the same small details as an illustration she published two years earlier. She sends a notice with both images side by side and the date of her original post. We review it, take the product offline while we look into it, and reply with what we found and what we did.
A similar subject, drawn differently
Someone writes that they also sell an embroidered mushroom design. Their mushrooms are tall and thin with stripes; ours are two round caps with white spots. Both show mushrooms, but the expression is different, so this is not a copy. We explain that in our reply and invite them to send more detail if they see a closer resemblance than we do.
A photo used without permission
A photographer finds that an image on one of our pages is his photograph. He sends a notice with a link to the original. We replace the image straight away and confirm by email. Images on our pages are meant to be our own or properly licensed, and we treat a mistake here as urgent.
6. Notices from outside the United States
We ship to Canada, Australia and New Zealand as well as the US, and we accept copyright concerns from rights holders anywhere. If your country’s law uses a different process from the DMCA, send us the information you have in the format that suits you, covering the same essentials: who you are, which work is yours, where the material appears on our site and why you believe it infringes. We will review it on the same basis.
7. Personalised text and customer orders
Customers type their own text into personalisation fields: initials, names, dates and short lines. We do not stitch team names, brand names, logos or characters, and we decline orders whose text appears to copy someone else’s protected work. Personalised pieces are made for one buyer and are not displayed for sale on the site. If you believe a personalised order reproduces your copyrighted text, contact us with the details you have and we will look into it.
8. Counter-notification
If material you provided to us was removed because of a copyright notice and you believe that was a mistake or a misidentification, you can send a counter-notification to the same address. It must include:
- your physical or electronic signature;
- identification of the material that was removed and where it appeared before removal;
- a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification;
- your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Embro Haven may be found), and that you will accept service of process from the person who sent the original notice or their agent.
When we receive a valid counter-notification, we forward it to the person who sent the original notice. The material may be restored after the period the DMCA describes unless the original sender tells us they have filed a court action about it.
9. Notices made in bad faith
Under US law, a person who knowingly and materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorneys’ fees. Please make sure your notice or counter-notice is accurate. If you are unsure whether material infringes your rights, consider getting legal advice before sending a notice.
10. Repeat infringement
Where appropriate, we will refuse further orders or close the accounts of customers who repeatedly ask us to reproduce material that infringes someone else’s copyright.
11. Our own designs
The designs we sell are created for Embro Haven. If you see our designs, photos or texts used elsewhere without permission, we would appreciate a short email with the link. Our Intellectual Property Policy explains how our own content may and may not be used.
12. Keeping records
We keep a record of each notice and counter-notice we receive, what material it concerned and what we did about it. This helps us apply the repeat-infringement rule fairly, avoid putting removed material back by accident, and answer follow-up questions from either side. Records are kept only as long as they are needed for those purposes, and they are never used for marketing or shared beyond what the notice process requires.
13. Information you send us
Notices and counter-notices contain personal information. We use it to handle the notice, may share it with the other party as the DMCA process requires, and otherwise treat it as described in our Privacy Policy.
